1. Agreement to These Terms
These Terms of Service (“Terms”) govern your access to and use of the website at https://acbreakz.net (the “Site”) operated by TS Data, LLC (“AC Breakz,” “we,” “us,” or “our”).
By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
2. What This Site Is — and What It Isn't
The Site is informational. It describes our business, our stream schedule, our retail location, and our team. It links to the platforms where our sales actually happen.
We do not sell products or break slots through this Site. All purchases occur on third-party platforms:
- TikTok / TikTok Shop : governed by TikTok's terms of service and purchase policies
- Whatnot : governed by Whatnot's terms of service, buyer protection policies, and dispute procedures
- Our retail location at 5020 Wellington Ave, Ventnor City, NJ : governed by applicable New Jersey law and the policies posted at our store
When you purchase through TikTok or Whatnot, that platform’s terms control the transaction, including payment, refunds, shipping guarantees, eligibility and age requirements, the terms of any break or slot purchase, and dispute resolution. Nothing in these Terms limits any rights you have under those platforms’ buyer protection policies.
3. In-Store Purchases and Sales
3.1 Purchases
Products purchased at our retail location are subject to the return and exchange policy posted at our store.
3.2 Sales to Us
We purchase cards, collectibles, and related items from the public.
- Any offer we make is at our discretion and is not binding until payment is tendered and the item is delivered.
- By selling an item to us, you represent that you are its lawful owner or authorized agent, that you have the right to sell it, and that it is not stolen, encumbered, or subject to any competing claim.
- We may require government-issued identification and may be legally required to record and report transaction detail
- We make no representation regarding grading, authenticity, or future value of items we purchase or decline.
4. Giveaways, Contests, and Promotions
Any giveaway, contest, sweepstakes, or promotion we run is subject to its own official rules, published at the time of the promotion. Where those rules conflict with these Terms, the official rules control.
5. Intellectual Property
5.1 Our Content
The Site and its contents — including the AC Breakz name and logo, text, graphics, photographs, video, and design — are owned by us or our licensors and are protected by intellectual property law. You may not copy, reproduce, distribute, or create derivative works without our prior written permission.
5.2 Third-Party Marks
Trademarks referenced on the Site, including Topps, Panini, Pokémon, Funko, and the names and marks of sports leagues, teams, and players, are the property of their respective owners. AC Breakz is not affiliated with, endorsed by, or sponsored by any of them. References are for descriptive purposes only, to identify products we sell.
6. User Content
If you submit content to us — through the contact form, comments, our Discord server, or stream chat — you grant us a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, and display that content in connection with operating and promoting our business.
You represent that you own or have the rights to any content you submit, and that it does not violate any law or thirdparty right.
We may remove any user content at our discretion.
7. Prohibited Conduct
- Use the Site for any unlawful purpose
- Attempt to gain unauthorized access to the Site, our systems, or other users' accounts
- Interfere with or disrupt the Site or its infrastructure
- Scrape, crawl, or harvest data from the Site except as permitted by our robots.txt
- Impersonate AC Breakz, our staff, or any other person
- Use the Site to transmit malware or harmful code
8. Third-Party Links and Platforms
The Site links to third-party platforms including TikTok, Whatnot, Discord, Instagram, Facebook, YouTube, Pinterest, and Google Maps. We do not control and are not responsible for their content, policies, availability, or practices. Your use of those platforms is at your own risk and subject to their terms.
9. Disclaimers
The Site is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and noninfringement.
We do not warrant that the Site will be uninterrupted, error-free, or secure, or that information on the Site — including stream schedules, store hours, product availability, and follower or member counts — is complete, current, or accurate at any given time.
10. Limitation of Liability
To the maximum extent permitted by law, AC Breakz and its owners, members, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising from or relating to your use of the Site.
Our total aggregate liability for any claim arising from or relating to the Site or these Terms will not exceed five hundred dollars ($500).
Nothing in this section limits liability that cannot be limited or excluded under applicable law.
11. Indemnification
You agree to indemnify and hold harmless AC Breakz and its owners, members, officers, employees, and agents from any claim, demand, loss, liability, or expense (including reasonable attorneys’ fees) arising from your use of the Site, your violation of these Terms, or your violation of any law or third-party right.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of New Jersey, without regard to its conflict of laws principles.
You and AC Breakz agree that any dispute arising from or relating to the Site or these Terms will be brought exclusively in the state or federal courts located in Atlantic County, New Jersey, and you consent to the personal jurisdiction of those courts.
This section applies to disputes concerning the Site itself. Disputes concerning purchases made on TikTok, Whatnot, or another third-party platform are governed by that platform’s dispute resolution provisions.
13. Changes to These Terms
We may modify these Terms at any time. Changes take effect when posted, with a revised “Last Updated” date at the top of this page. Your continued use of the Site after changes take effect constitutes acceptance.
14. Miscellaneous
- Severability : If any provision is held unenforceable, the remaining provisions remain in effect.
- No waiver : Our failure to enforce any provision is not a waiver of that provision.
- Entire agreement : These Terms, together with our Privacy Policy, constitute the entire agreement between you and AC Breakz regarding the Site.
- Assignment : You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
